Business tax planning in Texarkana, Texas

A Texarkana mailing address does not by itself establish the Arkansas border-city exemption. An owner needs the actual residence, income source, type of payment and filing position checked before assuming that all income is exempt or that no Arkansas return is needed.

This guide helps Texarkana owners compare cross-border tax planning and preparation. It is written for annual personal income before tax of at least $500,000, preferably $1 million or more. That is an audience focus, not an exemption threshold. Business turnover and a company's own tax obligations are separate questions.

Map the individual and the income before applying the exemption

Consider a hypothetical owner who lives in Texarkana, Texas, works on both sides of the state line and receives wages plus business-related income. A proposal that calls the owner a Texas resident and marks every Arkansas item exempt has skipped material questions.

Arkansas's rule defines the relevant individual taxpayer as a natural person and the two Texarkana resident categories by a place of abode within the respective city limits. Its Texas-side rule distinguishes income earned in Texarkana, Arkansas from other taxable income earned in Arkansas. Other Texas residents do not receive the same city-resident treatment merely because they work in Texarkana, Arkansas. [1]

Ask the reviewer to identify the actual taxpayer, physical residence, dates and each income stream. Do not infer the treatment of a company, trust or every payment to an owner from a rule framed for individual residents.

Distinguish the two city-resident positions

The rule says bona fide Texarkana, Arkansas residents are exempt on income received while residents of that city but must file an Arkansas income-tax return. It separately addresses income earned while resident elsewhere. For Texarkana, Texas residents, the source of Arkansas income matters to the stated exemption boundary. [1]

That distinction is particularly important when work moves between locations or residence changes during the year. Keep the timeline and source facts rather than use the year-end mailing address for every receipt. Have the adviser explain the actual period and items covered by the conclusion.

The Department of Finance and Administration's Subject 302 also requires a street address within the relevant city limits and says use of a post-office box or rural route for the claim will cause disallowance. [2] Confirm real residence evidence; an address format or a convenient business location is not a substitute for the underlying bona fide residence requirement.

Separate wage withholding from non-wage analysis

The 2026 Arkansas withholding instructions describe the Texarkana wage exemption and employer documentation. Those are payroll rules for the relevant employees and wages; they should not be generalized to every owner distribution or business receipt. [3]

Subject 302 distinguishes W-2 claims, with the employer's AR-TX documentation, from non-wage items for which that wage form is not required. It says additional information may be required to verify an allowed non-wage adjustment. [2]

For the hypothetical owner, first identify what each payment actually is. Then request the applicable source and exemption analysis for that category. The fact that a non-wage item does not require AR-TX does not prove the item is exempt. Nor does a payroll certificate decide the treatment of all other income on the personal return.

Item to reconcile Question the review should answer
Wages and work locations Which current payroll rules and documentation apply to the actual residence and work?
Business or pass-through-related items What is the item, who reports it and what source and exemption rules apply?
Income from other Arkansas locations Does the city exemption actually cover it for this resident category?
Residence or work changes Which periods and supporting facts affect the conclusion?

Do not apply an exemption by moving amounts between labels without supporting the legal and factual treatment. If another specialist must resolve a source or entity question, identify that dependency before relying on a total.

Expect a filing explanation as well as an exemption conclusion

Subject 302 describes reporting total income on an Arkansas return and claiming eligible income as an adjustment. [2] A statement that income may be exempt is therefore not the same as a conclusion that the claimant need not file.

Ask for a schedule connecting the relevant income records to the claimed eligible adjustment, taxable Arkansas items and supporting documents. Confirm the correct current forms and instructions for the actual return year. A withholding result during the year does not replace the final return review.

This is not a statement that every Texas resident must file an Arkansas return regardless of income or circumstances. The useful engagement gives the specific owner's filing reason and obligations, identifies any excluded items and explains which facts would change the answer.

Compare cross-border planning with routine preparation

A routine preparation offer may fit an established, supported position with complete records. An owner with mixed income, changed residence or work beyond the city needs the disputed assumptions resolved before simply repeating last year's treatment.

Compare whether the scope includes residence verification, item-by-item source analysis, payroll coordination, the personal filing position and separate company obligations. Request a written conclusion with evidence and exclusions rather than a broad statement that Texarkana income is tax free.

For a proposed business or residence change, ask the adviser to compare the actual alternatives and conditions without inventing a relocation benefit. Legal, payroll and business consequences remain relevant. This guide does not recommend moving or determine where a person is resident.

Coordinate the actual records and professional roles

Give the preparer the physical residence and dates, wage records, relevant business schedules, work-location evidence, prior returns and existing exemption documentation. Confirm who obtains missing employer records and who resolves a difference between payroll treatment and the planned return.

Verify claimed Texas CPA and relevant firm status through the Texas board, or enrolled-agent status through the IRS. [4][5] CPAs and enrolled agents are among professionals with unlimited IRS representation rights, subject to its rules. [6] For someone claiming another state's professional license, check the appropriate state's records as well.

Credential status is the starting point. Ask who has actual Arkansas/Texarkana source and filing experience, who reviews non-wage items and who handles a later question from the authority. Confirm the named reviewer, scope, fee basis and coordination with any company preparer.

Questions Texarkana owners ask about cross-border tax advice

Is every Texas resident working in Texarkana, Arkansas covered?

No. The rule distinguishes residents within Texarkana, Texas city limits from other Texas residents, and distinguishes relevant income sources. Establish the actual residence and work facts before applying the exemption. [1]

Does a wage exemption establish the result for distributions or other non-wage income?

No. Payroll documentation and wage rules do not decide every other income category. Subject 302 describes separate non-wage verification; eligibility and source still need review for the actual item and taxpayer. [1][2][3]

Does exempt income mean there is no Arkansas filing step?

Not automatically. The rule expressly requires an Arkansas return for the described Texarkana, Arkansas residents, and Subject 302 explains the return and eligible adjustment for an exemption claim. Have the adviser identify your actual filing position and current requirements. [1][2]
