Business tax planning in Sherman, Texas

Owing no Texas franchise tax does not automatically mean there is no research-credit question to review. The 2026 rules include a conditional refundable-credit route, with eligibility and filing requirements that differ from an ordinary no-tax-due assumption.

This guide helps Sherman business owners compare research-credit advice with routine preparation. It is written for annual personal income before tax of at least $500,000, preferably $1 million or more. That personal-income focus is not a Texas credit eligibility test or a measure of company revenue.

Discuss the business tax help you need

Start with the report year and the actual entity

Consider a hypothetical established technical business that incurred development costs but expects no franchise tax due. Its owner wants to know whether paying for a research-credit review is worthwhile, what the review must establish and which entity would make a claim.

The Comptroller says Subchapter M was repealed and Subchapter T took effect January 1, 2026. The new framework continued a franchise-tax research credit but did not continue the former research sales-tax exemption. It also describes a refundable credit for certain entities that do not owe franchise tax. [1]

Identify the report year, accounting period, taxable entity and any combined group before comparing proposals. A presentation describing the old choice between a research sales-tax exemption and a franchise-tax credit is not a complete explanation of the current route.

Separate no tax due from refundable-credit eligibility

The Comptroller identifies specific reasons an entity may owe no tax and potentially qualify for a refundable credit. It also states that an entity using the E-Z computation is not eligible for that refundable credit, even where the computed tax is small. [1]

The adviser should explain the actual reason for your entity's no-tax position and whether it fits the applicable pathway. A recommendation that begins and ends with no tax due misses the distinction. Equally, an expected refund is not established merely by naming a qualifying business activity.

Check combined-group facts as well. The Comptroller describes a restriction where the entity or a combined-group member received the former research sales-tax exemption in the relevant period, including its specific 2026-report explanation. [1] Supply the real prior claims rather than assume the new effective date erases earlier-period facts.

Test the research before assigning a credit value

The state definition uses qualified research expenses reported on IRS Form 6765 that are attributable to research conducted in Texas. The current framework requires the relevant federal filing; it is not simply a fresh estimate of all technical payroll. [1]

The IRS instructions describe a four-part qualified-research test applied separately to each business component, involving the relevant research expenditure, technological information, a new or improved component and a process of experimentation. They also identify excluded activities, including funded research and specified other categories. [2]

For the hypothetical company, give the reviewer the actual projects, technical uncertainties, work performed, results, people and contracts. A project that improved the business commercially does not automatically establish qualified research. Ask the reviewer to explain included and excluded activities and how the cost records connect to them.

The work should distinguish federal qualification from the Texas location and filing conditions. Do not treat a federal credit, an expense deduction and a Texas refundable credit as interchangeable benefits or assume one proves the others.

Compare a screening assignment with a supported claim

Work level What it should establish
Initial eligibility screen Relevant entity and year, no-tax reason, federal filing position, Texas activities and obvious restrictions.
Technical and cost review Why identified activities and costs qualify or do not, with project and location evidence.
Claim preparation Correct route, forms, reconciliation and current submission requirements for the actual entity or group.
Ongoing support Who handles changes, questions, evidence retention and future-period review.

A screen may appropriately conclude that a full claim is not supported or that missing information must be resolved first. Compare the fee basis and deliverables before commissioning a complete study. A success-based quote or projected refund does not replace the eligibility analysis.

The Comptroller describes different forms and procedures for tax-due and no-tax-due claims, a federal Form 6765 requirement, combined-group information and filing deadlines. [1] Have the reviewer identify the exact current requirements and who is responsible for meeting them. Do not assume the routine franchise filing covers every separate credit submission.

Make the result usable in the business forecast

Request a reconciliation from reviewed federal expenses to the eligible Texas amount, with entity, period and location differences explained. The conclusion should identify the applicable route, unresolved restrictions, required filings and the owner of each action.

Keep a conditional credit separate from cash already received. If the owner is planning distributions or commitments, explain what happens if evidence is insufficient, a cost is excluded or the claim is not accepted as proposed. The company claimant and the owner's personal forecast are connected financial concerns but are not the same taxpayer calculation.

IRS recordkeeping guidance identifies support for income, expenses and returns as purposes of business records. [3] Retain the technical evidence and cost reconciliation alongside the claim, not only a consultant's headline total.

Use Sherman project records for their actual purpose

Sherman's Building Permits and Inspections page lists new-construction and remodel checklists and a plan revision form, and asks applicants to confirm uncertain permit requirements with the City. [4]

If a development project also changes the premises, keep the current drawings and revisions with the project record. They may help explain what physically changed, but a City permit is not proof that the federal research test or Texas credit requirements are satisfied. Have the technical and tax reviewers identify the evidence actually needed for their conclusions.

Choose the reviewer for the current research-credit work

Verify claimed CPA and relevant firm standing through the Texas board, or enrolled-agent status through the IRS. [5][6] CPAs and enrolled agents are among professionals with unlimited IRS representation rights, subject to its rules. [7]

Then ask who reviews project qualification, federal filing, Texas attribution and the correct Subchapter T route. Can the candidate explain why a cost is excluded as clearly as why it is included? Who coordinates with your existing federal preparer and answers a later authority inquiry?

Confirm technical specialists, named reviewer, fee basis, exclusions and evidence ownership. A broad tax-planning menu or proximity to the business does not establish current research-credit expertise.

Questions Sherman owners ask about research-credit advice

Does owing no franchise tax rule out every Texas research credit?

No. The Comptroller describes a refundable-credit route for certain no-tax-due entities, with specific qualifying reasons and exclusions. Have the adviser check the actual entity, year and computation rather than assume automatic availability or automatic disqualification. [1]

Can a study count every engineering or software expense?

Not merely because the work has a technical label. The relevant qualified-research tests, excluded activities, cost rules, Texas attribution and filing requirements must be evaluated. Ask for supported included and excluded amounts. [1][2]

Is the former research sales-tax exemption still the same option in 2026?

No. The Comptroller says the new Subchapter T framework effective January 1, 2026 did not continue that exemption. Prior-period use can still affect the applicable claim restrictions, so provide the actual history. [1]
