Business tax planning in Fulshear, Texas

An inherited business-use asset should not automatically enter the new owner's tax records at the decedent's original cost, remaining depreciation balance or today's insurance value. Establish what was inherited, the applicable valuation date and any required estate-value consistency before planning its use or sale.

This guide helps Fulshear business and property owners compare inherited-asset tax advice. It focuses on annual personal income before tax of at least $500,000, preferably $1 million or more. Inheritance value and company turnover are different measures.

Discuss the business tax help you need

Identify the property actually received

Consider a hypothetical established business owner who inherits equipment directly from a parent and is deciding whether to use it in the business or sell it. The prior asset schedule shows a low remaining tax balance, while family members refer to a much higher current value.

Start with the estate documents, asset identity, ownership and date of death. Confirm that the inheritance is the actual equipment or property rather than an interest in a company that owns it. The adviser needs the correct inherited asset before applying a basis rule.

IRS Publication 551 generally describes inherited-property basis by reference to fair market value at death, an elected alternate valuation date or other specified rules. It also explains estate-value consistency requirements for certain beneficiaries. [1]

This discussion concerns tangible property. A right to income earned by the decedent, an inherited retirement account or another special item can require different analysis; do not apply one general property-basis explanation to every inheritance.

Establish the relevant value and date

The useful question is not whether a current price seems reasonable. It is which value and date the applicable rule requires and what evidence supports that amount.

Publication 551 describes circumstances in which beneficiaries receive Schedule A of Form 8971 reporting estate tax value and certain beneficiaries must use the required consistent basis. It also identifies alternate and special-use valuation situations. [1]

Ask whether such information or an election applies before arranging a new valuation on an assumed date. Obtain the actual executor's records and coordinate with the estate adviser where necessary. A number supplied informally by a relative should not be treated as the final tax conclusion.

For the hypothetical equipment, an appropriate valuation professional may be needed to establish the relevant historical fair market value. The tax adviser should identify the required evidence and how it is used, rather than promise that every inherited item receives a preferred higher figure.

Remember that a new basis can be lower as well as higher

The general fair-market-value rule is not a promise of a step-up above old cost. Where the relevant value is lower, the supported basis can also be lower. The actual rule, facts and exceptions govern. [1]

Publication 551 includes an exception for appreciated property received back from a decedent where the recipient or spouse gave it to the decedent within one year before death. It also describes distinct community-property and jointly held property situations. [1]

These qualifications matter where the facts fit; they are not reasons to complicate an unrelated inheritance unnecessarily. Give the reviewer the actual transfer and ownership history so they can identify which rules apply instead of applying every exception indiscriminately.

Connect the supported opening basis to the real decision

Once the opening basis is established, the adviser can evaluate the actual proposed use or disposition under the applicable rules. That later work may require further depreciation, business-use, sale or other analysis. The inherited value alone does not establish an immediate deduction or the tax on a future sale.

Record or decision What the owner needs explained
Inherited property Actual asset and ownership received, not an assumed underlying company asset.
Opening tax basis Applicable date, value, consistency rule and supported evidence.
Proposed use or sale Separate treatment under the actual property and transaction conditions.
Continuing records Who maintains adjustments and supplies the eventual preparer with the inherited history.

For the hypothetical owner, compare the genuine operating value of using the equipment with an actual sale alternative. Keep supported tax effects separate from cash, maintenance and commercial needs. Do not choose a value simply to make one alternative look better.

Define the estate-to-business handoff

The estate's preparer, executor, valuation professional and owner's adviser may have different responsibilities. Name who supplies title and transfer evidence, who confirms relevant estate values or elections and who reviews the opening basis used by the business.

The completed explanation should identify the actual inherited property, applicable rule, value and date, exceptions reviewed and outstanding facts. It should say what further work is needed before the proposed use or sale. An opening journal entry without that explanation does not demonstrate that the issue was resolved.

IRS recordkeeping guidance identifies property basis and return support as purposes of records. [2] Preserve the inherited history and reviewed conclusion with later adjustments so a new preparer does not revert to the decedent's old schedule or an unsupported current value.

Confirm Fulshear use changes using the actual property

Fulshear's new-business guidance lists CO, floor-plan and Fort Bend County Fire Marshal elements. It separately says conversion from residential use requires a special-use permit and commercial-code compliance. Confirm the actual use and current requirements with the City and relevant county authority. [3]

If inherited property is proposed for a different business use, give the local reviewers the real plan before assuming it can proceed. That conditional conversion rule should not be generalized to every inherited asset or every property. A land-use approval does not determine inherited tax basis, and a tax value does not authorize a use.

Choose a CPA or EA for inherited-asset coordination

Verify claimed CPA and relevant firm standing through the Texas board, or enrolled-agent status through the IRS. [4][5] Both are among professionals with unlimited IRS representation rights, subject to its rules. [6]

Ask about actual inherited business assets, estate-value consistency and coordination with executors and valuation specialists. Who decides what information is sufficient? Who reviews the opening schedule and explains the effect on the owner's business decision?

Compare scope, fee basis, named reviewer and exclusions. An accounting or wealth-management service may be useful, but its label does not establish that valuation-date evidence and the estate-to-business tax handoff are included.

Questions Fulshear owners ask about inherited assets

Should I copy the decedent's remaining depreciation balance as my basis?

Not automatically. The inherited-property rules generally use a relevant fair market value or another specified basis, with exceptions and possible consistency requirements. Establish the actual property, date and applicable treatment. [1]

Is inherited basis always increased above the old cost?

No. A rule based on fair market value can produce a lower value as well as a higher one. The result depends on the actual rule, required date and evidence, not a promise that every inheritance steps up. [1]

Does the opening basis determine every later deduction or sale result?

No. It is an input to the later analysis. The actual use, property, adjustments and proposed transaction still need review before relying on a deduction or owner cash forecast.
